Thank you for your interest in the YouTube channel of SOFiSTiK AG. YouTube is an Internet video portal that allows video publishers to post video clips for free and other users to view, rate and comment on them, also for free. YouTube allows the publication of all types of videos, which is why complete film and TV shows, but also music videos, trailers or videos made by users themselves can be accessed via the Internet portal.

 

Definitions


The data protection declaration of the SOFiSTiK AG is based on the terms used in the General Data Protection Regulation (DSGVO). For better comprehensibility, we would like to explain these terms in advance.


Personal data

Personal data is any information relating to an identified or identifiable natural person (hereinafter "data subject"). An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

Data subject means any identified or identifiable natural person whose personal data are processed by the controller.


Processing

Processing means any operation or set of operations which is performed upon personal data, whether or not by automatic means, such as collection, recording, organization, filing, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.


Restriction of processing

Restriction of processing is the marking of stored personal data with the aim of limiting their future processing.


Controller or person responsible for processing

Controller or controller is the natural or legal person, public authority, agency or other body which alone or jointly with others determines the purposes and means of the processing of personal data. Where the purposes and means of such processing are determined by Union or Member State law, the controller or the specific criteria for its designation may be provided for under Union or Member State law.


Third party

Third party means a natural or legal person, public authority, agency or other body other than the data subject, the controller, the processor and the persons who are authorized to process the personal data under the direct responsibility of the controller or the processor.


Consent

Consent is any expression of will in the form of a statement or other unambiguous affirmative act, given voluntarily by the data subject for the specific case in an informed manner and in an unambiguous manner, by which the data subject indicates that he or she consents to the processing of personal data relating to him or her.


Entity responsible for the processing

Within the framework of a tiered provider relationship, there is joint responsibility within the meaning of Art. 26 DSGVO of the SOFiSTiK AG together with YouTube LLC for data processing on the YouTube channel of the SOFiSTiK AG group.

Purpose and scope of data processing

The SOFiSTiK AG is present on social networks in order to present itself to users there and to communicate with them. The YouTube channel of the SOFiSTiK AG primarily serves as a  knowledge transfer for the external presentation of the group of companies as an attractive employer and competent service provider. The SOFiSTiK AG provides insight into the daily work routine as well as the service fields of the SOFiSTiK AG and informs about SOFiSTiK AG news. YouTube members have the opportunity to publicly contact the SOFiSTiK AG. This is done through a public comment on the SOFiSTiK AG's corporate channel. The personal contact is based on voluntariness and is in all cases initiated by the user.

The SOFiSTiK AG uses personal data exclusively for the analysis of user behavior via the statistics provided by YouTube as well as for communication with the user, provided that the user has initiated contact with the SOFiSTiK AG via the public comment function. YouTube provides personal data of users in aggregated and anonymized form. The following information is provided here by YouTube, for example: Followers, reach, demographics of users. These statistics do not allow any conclusions to be drawn about individual users. Information on personal data can therefore only be requested directly from YouTube. The SOFiSTiK AG can only view the public information of the users. The user determines which information this is in his private settings. In addition, the user has the option of actively hiding Likes or no longer following the SOFiSTiK AG's corporate channel. More information on this can be found at www.youtube.com/account_privacy. The deletion of the data on the part of the SOFiSTiK AG takes place after the purpose has ceased to exist. The SOFiSTiK AG has no influence on the deletion of data by YouTube. When visiting the YouTube channel of the SOFiSTiK AG, user data may be processed outside the area of the European Union. In these jurisdictions, German or European data protection law is generally not applicable. This may make it more difficult to enforce users' personal rights. US providers certified for the Privacy Shield have committed to comply with EU data protection standards. SOFiSTiK AG is subject to YouTube's privacy policy and has no influence on how YouTube uses personal data such as name, first name, IP addresses, etc. of users. The processing of the users' personal data is based on Art. 6 para. 1 lit. f. DSGVO. As the operator of a presence in a social medium, the SOFiSTiK AG has a legitimate interest in effectively informing users and communicating with users.

If the user has consented to the data processing - for example by clicking a checkbox - the legal basis for the processing is Art. 6 para. 1 lit. a., Art. 7 DSGVO.

The data policy published by Google as provider of the 'YouTube' service provides information about the collection, processing and use of personal data. When visiting the SOFiSTiK AG YouTube channel, personal data of the users is collected by YouTube as the responsible party. Such data collection by YouTube may also occur for visitors to this page who are not logged in or registered with YouTube. As a rule, YouTube uses and processes user data for market research and advertising purposes. For example, usage profiles can be created from the usage behavior and the resulting interests of the users. The usage profiles can in turn be used, for example, to place advertisements within and outside YouTube that presumably correspond to the interests of the users. The SOFiSTiK AG leaves the user free to use alternative means of communication - outside the network - to contact the SOFiSTiK AG (website, telephone, email, etc.).

Cookies are used to store or obtain IDs and other information on computers, phones and other devices. YouTube comment function

If a user leaves a public comment on the YouTube channel of the SOFiSTiK AG, these solely reflect the opinion of the user. The SOFiSTiK AG dissociates itself from any statements by third parties and assumes no responsibility or liability for the accuracy and completeness of the content and links set in comments. The SOFiSTiK AG reserves the right to delete at any time any user content (comments) that is inadmissible and/or contrary to public policy and/or violates the rights of others.


Danger to your data on the Internet

Both on the Internet in general and on social media platforms, there is the possibility of worldwide access or retrieval of the posted data and images, including from countries in which there is no or no sufficient data protection standard. The SOFiSTiK AG as operator of this offer can neither influence the access to its data via the Internet nor the use of this data and in this respect also cannot assume any guarantee for the observance of data protection in this environment.

Personal data can be found on the Internet using suitable search engines and the persons depicted in images can also be identified under certain circumstances. This also makes it possible to create personality profiles by combining this data and information with other data available on the Internet and to open up additional possibilities for use, for example for advertising purposes. Due to the possibilities of worldwide retrieval and storage of data by other bodies or persons, in the event of a request for deletion and despite removal of your data and images, further use by other bodies or persons or retrieval via archive functions of search engines cannot be ruled out.


Data subject rights of the users

Right of request:

You can request information from us as to whether and to what extent we process your data.


Right to rectification:

If we process your data that is incomplete or incorrect, you have the right to obtain from the controller without undue delay the rectification of inaccurate personal data concerning you.


Right to erasure (‘right to be forgotten’):

You can obtain the erasure of your data if we process it unlawfully or if the processing disproportionately interferes with your legitimate interests of protection. Please note that there may be reasons that prevent immediate erasure, e.g. in the case of legally regulated retention obligations.

Irrespective of the exercise of your right to erasure, we will erase your data without undue delay and completely, insofar as there is no legal or statutory retention obligation to the contrary.


Right to restriction of processing:

You may request us to restrict the processing of your data if

  • You contest the accuracy of the personal data for a period enabling us to verify the accuracy of the personal data.
  • the processing is unlawful, but you oppose the erasure of the personal data and request restriction of data use instead,
  • we no longer need the personal data for the intended purposes of the processing, but they are required by you for the establishment, exercise or defence of legal claims , or
  • You have objected to the processing pursuant to Art. 21 para. 1 pending the verification whether the legitimate grounds of us override those of you.


    Right to object:

If we process your data on the basis of legitimate interest, you can revoke this at any time; this would also apply to profiling based on these provisions. We will then no longer process your data unless we demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves the establishment, exercise or defense of legal claims. You have the right to object at any time without giving reasons to the processing of your personal data for such marketing, which includes profiling to the extent that it is related to such direct marketing.


Right to data portability:

You have the right to receive the personal data concerning you, which you have provided to us in a structured, commonly used and machine-readable format and that you have the right to transmit those data to another controller without hindrance from us, where:

  • we process such data on the basis of consent given by you, which may be revoked, or for the performance of a contract between us, and
  • the processing is carried out by automated means.

If technically feasible, you may request that we transmit your data directly to another data controller.


Right to lodge a complaint with a supervisory authority:

If you are of the opinion that we are violating German or European data protection law in the processing of your data, please contact us so that we can clarify any questions. Of course, you also have the right to contact the supervisory authority responsible for you, the respective state office for data protection supervision.

Right to withdraw consent

Automated individual decision-making, including profiling

You have the right not to be subject to a decision based solely on automated processing - including profiling - which produces legal effects concerning you or similarly significantly affects you. Exceptions to this only apply under the conditions of Article 22 para. 2 of the GDPR.

 

Google is exclusively responsible for the implementation of these rights under Articles 15-20 of the GDPR with regard to data stored by Google after joint processing. You also have a right of objection and right of complaint, as described herein, against us.
