Privacy Policy - Vimeo

Thank you for your interest in the Vimeo channel of SOFiSTiK AG. Vimeo is an internet video portal that allows video publishers to post video clips for free and other users to view, rate and comment on them, also for free. Vimeo allows the publication of all types of videos, which is why complete film and TV shows, but also music videos, trailers or videos made by users themselves can be accessed via the Internet portal.
 

Definitions

SOFiSTiK AG's privacy policy is based on the terms used in the General Data Protection Regulation (GDPR). For clarity, we would like to explain these terms in advance.


Personal data

Personal data means any information relating to an identified or identifiable natural person (hereinafter "data subject"). An identifiable natural person is defined as a person who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or one or more characteristics specific to the physical, physiological, genetic, psychological, economic, cultural or social identity of that natural person.


Data subject

Data subject means any identified or identifiable natural person whose personal data is processed by the controller.


Processing

Processing means any operation or set of operations which is performed upon personal data, whether or not by automatic means, such as collection, recording, organization, filing, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.


Restriction of processing

Restriction of processing means the marking of stored personal data with the aim of limiting their processing in the future.


Controller or person responsible for the processing

Controller or person responsible for the processing means the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data. Where the purposes and means of such processing are determined by EU or Member State law, the controller or the specific criteria for the controller's nomination may be provided for by EU or Member State law.


Third party

Third party means a natural or legal person, public authority, agency or body other than the data subject, controller, processor and persons who, under the direct authority of the controller or processor, are authorized to process personal data.


Consent

Consent of the data subject means any freely given, specific, informed and unambiguous indication of the data subject's wishes by which he or she, by a statement or by a clear affirmative action, signifies agreement to the processing of personal data relating to him or her.


Controller

Within the framework of a tiered provider relationship, there is a joint responsibility within the meaning of Art. 26 DSGVO of SOFiSTiK AG together with Vimeo Inc. for the data processing on the Vimeo channel of the SOFiSTiK AG Group.

Purpose and scope of data processing

SOFiSTiK AG has a presence on social networks in order to present itself to users there and to communicate with them. SOFiSTiK AG's Vimeo channel primarily serves as a marketing tool for personnel and knowledge transfer, etc., to present the group of companies to the outside world as an attractive employer and a competent service provider. SOFiSTiK AG provides insight into the daily work activities as well as SOFiSTiK AG's service areas and provides information with company news. Vimeo members have the possibility to publicly contact SOFiSTiK AG. This is done by making a public comment on SOFiSTiK AG's corporate channel. The personal contact is based on voluntary action and in all cases is initiated by the user.

SOFiSTiK AG uses personal data exclusively for the analysis of user behavior via the statistics provided by Vimeo and for communication with the user, insofar as they have started contact with SOFiSTiK AG via the public comment function. Vimeo provides personal data of the users in aggregated and anonymized form. The following information is provided here by Vimeo, for example: Followers, reach, demographics of the users. These statistics do not allow any conclusions to be drawn about individual users. Information about personal data can therefore only be requested directly from Vimeo. SOFiSTiK AG can only view the public information of the users. Which information this is, is defined by the user in his private settings. In addition, the user has the option to actively hide Likes or to no longer follow the SOFiSTiK AG company channel. More information on this can be found at https://vimeo.com/privacy . The deletion of the data on the part of SOFiSTiK AG will take place after the purpose has ceased to exist. SOFiSTiK AG has no influence on the deletion of data by Vimeo.  

When visiting the Vimeo channel of SOFiSTiK AG, user data may be processed outside the area of the European Union. In these jurisdictions, German or European data protection law is generally not applicable. The enforcement of personal rights of the users may be more difficult. SOFiSTiK AG is subject to the data protection regulations of Vimeo and has no influence on how Vimeo uses personal data such as name, first name, IP addresses, etc. of users. The purpose and scope of the data collection and the further processing and use of the data by Vimeo, as well as the related rights and settings options for protecting the privacy of users, can be found in the privacy policy of Vimeo https://vimeo.com/privacy .

The processing of the users' personal data is based on Art. 6 para. 1 lit. f. DSGVO. As the operator of a presence in a social medium, SOFiSTiK AG has a legitimate interest in effectively informing users and communicating with users.

If the user has consented to the data processing - for example by clicking on a checkbox - the legal basis for the processing is Art. 6 para. 1 lit. a., Art. 7 DSGVO.

When visiting the SOFiSTiK AG Vimeo channel, Vimeo as the responsible party collects personal data of the users. Such data collection by Vimeo may also occur for visitors to this page who are not logged in or registered with Vimeo. Vimeo generally uses and processes user data for market research and advertising purposes. For example, usage profiles can be created from the usage behavior and the resulting interests of the users. The usage profiles can in turn be used, for example, to place advertisements within and outside of Vimeo that presumably correspond to the interests of the users. For these purposes, cookies are usually stored on the computers of the users, in which the usage behavior and the interests of the users are stored. Furthermore, data may also be stored in the usage profiles regardless of the devices used by the users (especially if the users are members of Vimeo and are logged in to them).

In the case of requests for information and the assertion of user rights, it is pointed out that these can be asserted most effectively directly against Vimeo. Only Vimeo has access to the data of the users and can directly take appropriate measures and provide information.

SOFiSTiK AG leaves it up to the user to use alternative means of communication - outside the network - to get in contact with the company (website, telephone, e-mail, etc.).

Vimeo sets cookies to provide, protect, and improve Vimeo services. Cookies are small devices used to store information in web browsers. Cookies are used to store or obtain IDs and other information on computers, phones, and other devices.


Vimeo comment function

If a user leaves a public comment on the Vimeo channel of SOFiSTiK AG, these comments alone reflect the opinion of the user. SOFiSTiK AG dissociates itself from any statements made by third parties and assumes no responsibility or liability for the accuracy and completeness of the content and links set in comments. SOFiSTiK AG reserves the right to delete at any time any user content (comments) that is inadmissible and/or contrary to public morality and/or violates the rights of others.


Threats to your data on the Internet

Both on the Internet in general and on social media platforms, there is the possibility of worldwide access or retrieval of the posted data and images, even from countries where there is no or no sufficient data protection standard. SOFiSTiK AG as the operator of this offer can neither influence the access to its data via the Internet nor the use of this data and therefore cannot assume any guarantee for the observance of data protection in this environment.

Using suitable search engines, personal data can be found on the Internet and the persons depicted in images can also be identified under certain circumstances. This also makes it possible to create personality profiles by combining this data and information with other data available on the Internet and to open up additional possibilities for use, for example for advertising purposes. Due to the possibilities of worldwide retrieval and storage of data by other bodies or persons, in the event of a request for deletion and despite removal of your data and likenesses, further use by other bodies or persons or retrieval via archive functions of search engines cannot be ruled out.


Data subject rights of the users

Unfortunately, we cannot fulfill our information obligations according to Art. 13 EU-DSGVO, as only Vimeo has full access to the user data. If you wish to exercise your data subject rights, please contact Vimeo directly here. These rights include the following:


Right of access:

You can demand information from us as to whether and to what extent we process your personal data.


Right of rectification:

If we process your personal data that are incomplete or incorrect, you can demand that we correct or complete such data at any time.


Right to erasure

You can demand that we erase your personal data if we process the data unlawfully or if the processing interferes unjustifiably with your legitimate data protection interests. Please note that there may be reasons that prevent an immediate erasure, for example, in the case of statutory retention obligations.

Irrespective of the exercising of your right to erasure, we will erase your personal data immediately and completely, provided that there is no legal or statutory obligation to retain the data.


Right to restriction of processing:

You can demand that we restrict the processing of your personal data if:

  • you contest the accuracy of your personal data, for a period of time that enables us to verify the accuracy of the personal data.
  • the processing is unlawful and you oppose the erasure of the personal data and request the restriction of their use instead;
  • we no longer need the personal data for the purposes of the processing, but you still require the data for the establishment, exercise, or defense of legal claims; or
  • you have lodged an objection to the processing of the data.


    Right to data portability:

You may request that we provide you with the personal data you have provided to us in a structured, commonly used, and machine-readable format and that you may transfer those data to another data controller without hindrance from us, provided that

  • we process such data on the basis of a revocable consent given by you or for the fulfillment of a contract between us; andthis processing is carried out by automated means.
  • Where technically feasible, you may request us to transfer your personal data directly to another data controller.


Right to object:

If we process your personal data out of a legitimate interest, you can object to this data processing at any time; this would also apply to profiling based on these provisions. We will then no longer process your personal data unless we can demonstrate compelling legitimate grounds for processing that override your interests, rights, and freedoms or unless the processing serves the establishment, exercise, or defense of legal claims. You may object to the processing of your personal data for the purpose of direct marketing at any time without having to give reasons.


Right to lodge a complaint:

If you believe that we are processing your personal data in violation of German or European data protection law, please contact us so that we can clarify any questions you may have. Of course, you also have the right to contact the supervisory authority responsible for you, i.e. the respective state office for data protection supervision.

If you wish to assert any of the above rights against us, please contact our data protection officer. In cases of doubt, we may request additional information to confirm your identity.

Vimeo alone is responsible for implementing these rights under Articles 15 to 20 of the GDPR with respect to data stored by Vimeo after joint processing. You also have a right to object and to lodge a complaint, as described above, with regard to us.
